Prerequisites
- You have had a residence permit for the purpose of joining your spouse or an independent right of residence for at least 5 years.
- You have dissolved your marital or civil partnership, for example through permanent separation or divorce.
- You can prove that you have sufficient means of subsistence and health insurance without having to rely on public funds.
- Your former spouse or life partner owns
- a residence permit,
- a permanent residence permit for the EU or
- German citizenship.
- You have sufficient living space for yourself and your children in your household.
- There is no interest in deporting you. You have not yet received a deportation order.
Documents required
- valid passport or passport replacement
- biometric passport photo in electronic form
- You must take a passport photo on-site. A photo booth is available on-site.
- Proof of securing livelihood:
- by yourself
- by your former spouse or life partner
- Proof of health insurance coverage
- Proof of the dissolution of the marital or civil partnership, for example through a divorce certificate or a letter of termination of the joint residence
- Employment contract and a current certificate from the employer
- last 12 pay slips
- Certificate “Living in Germany”
- German language certificate, at least level B1 of the Common European Framework of Reference for Languages
- current pension insurance history from the German Pension Insurance
- Rental agreement with current rent
- If necessary, the competent authority requires further documents, information or evidence
The documents and information must generally be submitted in German.
Please note
You must pay the processing fee in any case. If your application is rejected, the fee will not be refunded, not even partially. You can reapply for a permanent residence permit at any time.
If you have proven that you have acquired the necessary language skills during your school leaving certificate, your training or your studies in Germany, you do not need a language certificate or the “Living in Germany” certificate.
Deadlines
Apply for a settlement permit at least 6 - 8 weeks before your current residence permit expires.
The settlement permit is valid indefinitely. The electronic residence permit card issued with it is valid for 10 years and must then be updated.
