Apply for a settlement permit for holders of a residence permit for international, humanitarian or political reasons

Detailed description

The settlement permit is a permanent residence permit. It is an independent right of residence, meaning it is independent of the original reason you came to Germany.

You can work with it, live anywhere in Germany and there are usually no additional requirements.

 

Information

Prerequisites

  • You have had a valid residence permit for 5 years from:
    • international law,
    • humanitarian or
    • political reasons.
  • You can pay for your living expenses and health insurance yourself without government assistance.
  • You or your spouse have made compulsory or voluntary contributions to statutory pension insurance into your account for 60 months.
  • You have no criminal record.
  • You or your spouse or life partner have a license to practice the profession on a permanent basis.
  • Knowledge of German (level B1 of the Common European Framework of Reference for Languages).
  • You have basic knowledge of the legal and social system and living conditions in Germany.
  • You have sufficient living space for yourself (and your children who belong to the household).
  • There is no interest in deporting you and you have not yet received a deportation order.

Documents required

  • Valid passport or passport replacement
  • Biometric passport photo in electronic format. You must take a passport photo on-site. A photo booth is available for your convenience.
  • Employment or extension contract
  • current certificate from the employer
  • Copy of the last 12 pay slips
  • Certificate “Living in Germany”
  • Language certificate
  • current pension insurance history from the German Pension Insurance
  • Rental agreement and current rent
  • If necessary, the competent authority requires further documents, information or evidence

Please note

If you are in possession of a residence permit as a person entitled to asylum, a recognized refugee under the Geneva Convention on Refugees, or a resettlement refugee, you can obtain a settlement permit under simplified conditions (see benefits: "Settlement permit for holders of a residence permit as a recognized person entitled to asylum or refugee" and "Settlement permit for the resettlement of persons seeking protection (resettlement refugees)").



If you have proven that you have acquired the necessary language skills during your school leaving certificate, your training or your studies in Germany, you do not need a language certificate or the “Living in Germany” certificate.



If you are unable to acquire language skills due to illness or disability, you must provide appropriate documentation, such as a doctor's report or confirmation of a place in a residential home.



If you have been granted a residence permit as a minor, you can obtain a settlement permit under simplified conditions (see services “Settlement permit granting for minor children”)

Deadlines


  • Apply for a settlement permit at least 6 - 8 weeks before your current residence permit expires.

  • The settlement permit is valid indefinitely. The electronic residence permit card issued with it is valid for 10 years and must then be updated.

Procedure

  • You use the online service to apply for a permanent residence permit and upload the required documents.
  • The responsible office will then send you an appointment for an interview.
  • Please bring all necessary documents, preferably in original, to the appointment.
  • The responsible authority will check your identity and your documents.
  • If your application is approved, your fingerprints, signature and a biometric photo will be taken to produce the electronic residence card (eAT card).
  • The responsible authority commissions an external agency, the Federal Printing Office, to produce the eAT card.
  • As soon as it's ready, you'll receive a notification and can pick it up in person from the responsible office. The responsible office will schedule an appointment for you.
  • If the application is rejected, you will receive a rejection notice with the reasons for the rejection.

Processing time


  • Processing usually takes 6 - 8 weeks if all documents are complete.

  • It takes approximately 4 - 6 weeks for the Federal Printing Office to produce the electronic residence permit.
