Detailed description

Resettlement is the organized reception of refugees from the first country of refuge when there is no prospect of integration there and no possibility of returning to the country of origin.


After 3 years of residence in Germany, you can apply for a settlement permit as a resettlement refugee.



The settlement permit is a permanent residence permit. It allows you to work and live anywhere in Germany, and there are usually no additional requirements.

 

Information

Prerequisites

  • You have a valid residence permit as a resettlement refugee.
  • You have been living in Germany with a residence permit for at least five years. The time spent in the asylum process is also counted.
  • The reasons for your recognition as a person entitled to asylum or refugee still apply.
  • The Federal Office for Migration and Refugees (BAMF) will check three years after your recognition whether the reasons still apply.
  • If you were recognized in 2015, 2016 or 2017, you have a confirmation from the BAMF that your recognition will not be revoked or withdrawn.
  • If you wish to obtain a permanent residence permit after 3 years:
    • You have a good command of the German language (level C1),
    • You and your spouse or life partner jointly provide for your livelihood and that of your family members who live with you in the same household.
    • As a rule, you must be able to cover at least 75% of your living expenses yourself without state assistance.
  • If you wish to obtain a permanent residence permit after 5 years:
    • You have sufficient knowledge of German (level A2),
    • You and your spouse or life partner can generally cover more than 50% of your living expenses for yourselves and your family members who belong to the household without having to rely on public benefits.
      • This requirement is waived if you have reached retirement age.
  • You have a permanent work permit.
    • If you are married or in a registered civil partnership, it is sufficient if your partner has this permission.
    • If you work in a regulated profession, you must have the necessary professional authorization (for example, a license to practice or a professional permit).
    • In a marriage or registered civil partnership, it is sufficient if your partner has permission.
  • You have sufficient living space for yourself and your family members who belong to the household.
  • You have adequate health insurance.
  • You have no criminal record.
  • There is no interest in deporting you and you have not yet received a deportation order.

Documents required

  • Valid passport or passport replacement
  • Biometric passport photo in electronic form
    • You must take a passport photo on-site. A photo booth is available for your convenience.
  • Employment or extension contract
  • current certificate from the employer
  • last 12 pay slips
  • Certificate “Living in Germany”
  • Language certificate
    • if applying after three years: C1
    • when applying after five years A2
  • current pension insurance history from the German Pension Insurance
  • Rental agreement and current rent
  • If necessary, the competent authority requires further documents, information or evidence

Please note

If you have proven that you have acquired the required language skills during your school leaving certificate, your training or your studies in Germany, you do not need a language certificate or the “Living in Germany” certificate.



If you are unable to learn a language due to illness or disability, you must provide appropriate documentation, such as a doctor's report or confirmation of a place in a residential care facility.

Deadlines


  • Apply for a settlement permit at least 6 - 8 weeks before your current residence permit expires.

  • The settlement permit is valid indefinitely. The electronic residence permit card issued with it is valid for 10 years and must then be updated.

Procedure

  • You use the online service to apply for a permanent residence permit and upload the required documents.
  • The responsible office will then send you an appointment for an interview.
  • Please bring all required documents, preferably in original, to the appointment.
  • The responsible authority will check your identity and your documents.
  • If your application is approved, your fingerprints, signature and a biometric photo will be taken to produce the electronic residence card (eAT card).
  • The responsible authority commissions an external agency, the Federal Printing Office, to produce the eAT card.
  • As soon as it's ready, you'll receive a notification and can pick it up in person from the responsible office. The responsible office will schedule an appointment for you.
  • If your application is rejected, you will receive a rejection notice stating the reasons for the rejection.

Processing time


  • Processing usually takes 6 - 8 weeks if all documents are complete.

  • It takes approximately 4-6 weeks for the Federal Printing Office to produce the electronic residence permit.
