If your income or assets are not sufficient for your necessary living expenses


If you live in a special form of integration assistance (SGB IX) due to an addiction, you will receive basic social security under certain conditions.

Detailed description

You can receive financial support through basic security in old age and in the event of incapacity for work.
This will help you finance your living expenses and cover the socio-cultural minimum subsistence level.
It is a social assistance benefit and fulfils the same function as subsistence aid, but for a specific group of people.
The granting of benefits requires need.
Basic security basically covers various needs, including:

  • the relevant standard requirement
  • Accommodation needs; as far as they are reasonable
  • additional requirements, such as additional requirements for:
    • Possession of a severely disabled person’s ID card with the symbol G, or
    • Illness if a special diet is required for medical reasons
    • pregnancy
  • One-off needs in special situations (e.g. initial furnishings for the apartment)
  • Needs for health/nursing care insurance
 

Information

Prerequisites

  • Due to an addiction, they live in a special form of residential integration assistance.
  • You have your habitual residence in Germany.
  • Your income and assets are not sufficient to support yourself.
  • You have reached the retirement age (66 – 67 years) or are over 18 years old.
  • You are permanently fully disabled or are undergoing the entry procedure and vocational training in a workshop for people with disabilities or with another service provider.

Documents required

  • Completed application
  • Proof of income/assets, as well as bank statements for the last three months
  • Living and care contract and subsequent changes, in particular with regard to the rent and, if applicable, rental agreement/current rental change letters/current utility and heating cost statements
  • receipts for current expenses
  • If available: severely disabled person's ID card
  • If applicable, when applying for total incapacity for work:
  • Legal opinion/decision from the pension provider or pension insurance company regarding permanent, full incapacity for work
  • If available: first pension notice
  • If necessary, further documents

Please note

Anyone who is classified as permanently and fully disabled by the specialist committee of a workshop for disabled people (work area) is also entitled to basic security benefits, regardless of age.



New from 2020:


If social assistance benefits to secure livelihoods are granted in addition to outpatient integration assistance (EGH) benefits, the beneficiary will receive these two benefits from different departments from 2020 onwards. The EGH benefit notification is issued centrally by the Integration Assistance Office in the Wandsbek district (W / EH) and the notification on social assistance benefits is issued by the responsible social welfare office in the district.

You can receive benefits from the first day of the month in which you applied.


The benefit is usually approved for twelve calendar months.


If you meet the requirements but the review of your application is time-consuming, you can also receive a provisional permit for six months.


However, a provisional decision must be made on the provision of cash benefits if it is established that a person falls within the personal scope of application of Chapter 4 of the SGB XII and


1. it is likely that a longer period of time will be required to determine the further requirements for entitlement to cash benefits and the further requirements for the entitlement are met with sufficient probability, or


2. there is a claim to financial benefits in principle


and it is likely that a longer period of time will be required to determine its amount.

Procedure

You submit the application for basic security in old age and in the event of reduced earning capacity and submit the evidence requested by the social welfare agency.


The responsible authority will examine your application and calculate your needs and the benefits you are entitled to.


If your application is approved, you will receive an approval notice; if it is rejected, you will receive a rejection notice.


In both cases, the decision contains the reasons for the decision.


It also contains information about the possibility of appealing against the decision (legal remedy instructions). This includes information about the deadline within which you can appeal.


The approval notice contains the amount of the benefit to be paid and the start date of payment. From the date stated, the benefits to which you are entitled will be made available to you by the responsible provider, usually at the beginning of the month.
