In matters relating to inheritance, the probate court at the local court is the competent authority.


If you want to settle something related to an estate, you must contact the probate court. The probate court is the right place for you if, for example, you

  • You need a certificate of inheritance to prove your right to inherit.
  • Would you like to deposit or have a will opened? Wills can be submitted in person at any time or sent by mail to the probate court. No appointment is necessary.
  • If you do not wish to accept (reject) an inheritance or require a certificate of executorship, please make an appointment in advance.

Prerequisites

There is an inheritance.

Documents required

General documents:

  • Identity card or passport
  • Death certificate of the deceased person
  • Proof that you are the heir (for example, through civil status documents, inheritance contracts or wills)

Depending on the nature of your request, the responsible authority may request further documents from you.

Please note

The local court in the place where the deceased last lived is responsible for probate matters. However, the application can also be filed with the local court at the heir's place of residence.

A notary can also accept and forward the application.

You cannot obtain legal advice from the probate court. For this, contact a law firm or notary's office. If you have a low income, the Public Legal Information Service (ÖRA) offers affordable advice.

Deadlines

Depending on the nature of your request, different deadlines may apply.

Procedure

  • You can make an appointment with the responsible office. You can use the online services for this purpose.
  • At the appointment, you will present your concerns and, if necessary, submit an application regarding an inheritance matter.
  • The responsible authority will decide on your application.
